5. Trading Disclaimer Trading financial instruments involves significant risk and can result in the loss of your invested capital. You should not invest more than you can afford to lose. Past performance is not indicative of future results. You acknowledge that you understand these risks and that you are responsible for any trading decisions you make.
6. Software Disclaimer The Software (scalper terminal) is provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not guarantee that the Software will be free of bugs, errors, or interruptions. Startuptify Technologies LLP shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to any bugs, errors, or interruptions in the Software.
7. Limited Uptime and Trading Instruments We do not guarantee 100% uptime for the Services. There may be periods when the Services are unavailable due to maintenance, updates, or technical issues. Additionally, we provide access to a limited range of trading instruments, and the availability of specific instruments may change without notice.
8. Broker and API Disclaimer We are not responsible for any failures, technical issues, or glitches related to your broker or the broker’s API. You, as the user, agree to submit your broker API key and save it on our server. While we take the best possible steps to protect your broker API keys, we cannot guarantee their absolute security.
9. Payment Processing We use Razorpay as our payment partner for processing any payments. Any technical glitches, failures, or issues related to payment processing are handled by Razorpay. Razorpay, in turn, depends on their banking partners. We are not responsible for any payment processing issues that arise from Razorpay or their banking partners.
10. User Content You retain ownership of any content you post on the Site. By posting content on the Site, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, publish, transmit, host, and display such content.
11. Intellectual Property All content, trademarks, logos, and intellectual property on the Site and in the Software are the property of Startuptify Technologies LLP or its licensors. You may not use, reproduce, or distribute any content without our prior written permission.
12. Termination We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without notice and for any reason, including, without limitation, breach of these Terms.

Limitation of Liability To the fullest extent permitted by law, Startuptify Technologies LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (iv) any bugs, errors, or interruptions in the Software; (v) any failures, technical issues, or glitches related to your broker or the broker’s API; (vi) any issues related to payment processing by Razorpay or their banking partners.
14. Governing Law These Terms shall be governed and construed in accordance with the laws of [India/Maharashtra], without regard to its conflict of law principles.
